Terms of Service

These terms are a contract between you and [LEGAL ENTITY NAME] (“FullyVerify”, “we”). By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1. The service

FullyVerify submits email addresses you upload to multiple third-party verification providers and reports each provider’s verdict plus a combined result based on rules you configure.

2. Accounts

You must give accurate registration information and are responsible for everything that happens under your account. Tell us promptly if you suspect unauthorised access. One free trial per person or organisation.

3. Credits

  • One credit verifies one email address across every provider in that bundle — a five-provider bundle still costs one credit per address.
  • Credits are prepaid, tied to the specific bundle you bought them for, and cannot be moved between bundles. A bundle’s set of providers is fixed when you create it.
  • Credits are deducted when a job starts. If a job fails on our side, the credits for that job are returned to the bundle automatically.
  • Credits have no cash value and are not transferable or redeemable for money.

4. Payment, tax and refunds

Payments are processed by Stripe. Prices are in US dollars and exclusive of tax. We add GST/HST or other sales tax where we are required to collect it, based on where you are located; if you are a business registered for VAT or GST outside Canada, you are responsible for self-assessing any tax due in your own jurisdiction.

Credits are prepaid and non-refundable once delivered to your bundle, except where we fail to deliver credits you paid for, or where a non-excludable consumer right applies. If you think you were charged in error, contact us within 30 days and we will look into it.

If you are buying as a consumer rather than for a business, and you live somewhere with a statutory cancellation period for digital purchases (including the United Kingdom and the European Economic Area, which give you 14 days): credits are delivered to your bundle immediately on payment. By completing checkout you ask us to begin supplying them at once and acknowledge that you lose your right to cancel once they have been delivered. Where the law does not allow that right to be waived, you keep it.

5. Your data and your responsibilities

You keep all rights to the email addresses and lists you upload. You grant us only the licence needed to run the verification you requested. You represent that:

  • you have a lawful basis to submit each address for verification, and uploading it does not breach any law, contract or privacy policy that applies to you;
  • you will comply with applicable anti-spam and data protection law in how you use the results — including Canada’s Anti-Spam Legislation (CASL), CAN-SPAM, the GDPR and UK GDPR, PIPEDA and Quebec’s Law 25, and the CCPA, to the extent each applies to you;
  • the addresses you upload were not collected by address-harvesting software or by any other means CASL prohibits.

How we handle the addresses you upload — and the commitments we make to you as a processor of that data — are set out in our Data Processing Agreement, which forms part of these terms.

6. Acceptable use

You may not use FullyVerify to:

  • verify lists you scraped, bought or otherwise obtained without a lawful basis;
  • support spam, phishing, fraud, harassment or malware distribution;
  • harvest, enumerate or validate addresses in order to attack a domain or its users;
  • resell or white-label the service without our written agreement, or circumvent credit limits and rate limits;
  • reverse engineer the service or use it to build a competing product.

We may suspend or terminate an account that breaches this section, without refund.

7. Accuracy — important

Email verification is probabilistic, not certain. Providers disagree, and every provider returns some wrong answers. Catch-all domains in particular cannot be resolved reliably by any provider. The point of this product is to make that disagreement visible so you can judge it — not to guarantee a correct verdict.

We do not warrant that any result is accurate, and we are not responsible for the consequences of you acting on one, including bounced messages, blocked domains or harm to your sender reputation. Verification results are provided as information, not as a recommendation to send.

8. Third-party providers

Verification depends on third-party providers. Their availability, accuracy, pricing and terms are outside our control. If a provider is unavailable or changes its service, the parts of FullyVerify that depend on it may be affected.

9. Availability

We aim to keep the service running but offer no uptime guarantee unless we have signed a separate agreement with you. We may change, suspend or discontinue features, and will give reasonable notice of material changes where we can.

10. Disclaimer

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event giving rise to it. Nothing here excludes liability that cannot lawfully be excluded.

12. Indemnity

You will indemnify us against claims arising from the data you upload or from your use of the service in breach of these terms or of applicable law.

13. Termination

You may close your account at any time. We may suspend or terminate access for breach of these terms, or for non-payment. On termination your unused credits are forfeited unless the law says otherwise, and we will delete your data in line with our Privacy Policy.

14. Changes to these terms

We may update these terms. Material changes will be announced in the app or by email, and continuing to use the service after they take effect means you accept them.

15. Governing law

These terms are governed by the laws of the Province of [PROVINCE] and the federal laws of Canada that apply in it, without regard to conflict-of-laws rules. The courts of [PROVINCE] have exclusive jurisdiction over any dispute.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country or province where you live, or of your right to bring a claim in your local courts where the law gives you that right.
